EFFECT OF BEING UNABLE TO PERFORM THE MENTAL DEMANDS OF WORK

In Social Security disability cases, decision makers will often deny a claim on the supposition that the claimant can still perform unskilled, sedentary work.  Examples of such unskilled sedentary work might be a surveillance system monitor, or a document preparer. All work has mental as well as physical demands.  The mental demands of unskilled sedentary work are defined by SSR 96-9p and SSR 85-15.  Those demands include the abilities (on a sustained basis) to understand, carry out, and remember simple instructions; to respond appropriately to supervision, coworkers, and usual work situations; and to deal with changes in a routine work setting. The loss of any of the above abilities will substantially erode the occupational base for sedentary, unskilled work and will, therefore, justify a finding of disability. Note that in order to work, a person must be able to meet the mental demands of full time, remunerative work "on a sustained basis."  A...

DISABILITY TIME FRAMES: HOW LONG WILL IT TAKE?

Every disability case is different, even though all have some common elements.  I am attempting here to answer the common question, "How long will it take to get disability benefits?"  I practice in Alabama, so my answers concern Social Security applications in Alabama--but I doubt it is much different anywhere in the country.  The waiting times are approximately the same. THE INITIAL DECISION .  From the time you file your initial application, it will usually take between 90 and 120 days to get a decision.  The decision will be quicker if the claimant has a terminal illness or meets criteria for one of the "compassionate allowance" diseases.  A veteran with a 100% permanent disability from the VA may also get a faster decision. THE APPEAL.  The appeal involves attending a hearing before an administrative law judge.  The average wait time to get a hearing in Alabama is now just over 15 months .  Individuals described in the above paragra...

DISABILITY BENEFITS: WHAT YOU REALLY NEED TO KNOW

You Must File a Timely Application.  You must apply for Social Security disability benefits within 5 years after you stop working.  Your insured status will expire, making a new claim impossible for an impairment that began later.  If there are gaps in your work history, you may have even less time to file a new claim.  Don't wait too long to file after you stop working. Denials Are Common But Almost Half of Them Can Be Won on Appeal.  Around 70 percent of all disability claims will be denied.  Social Security will tell you that you do not meet their rules to get benefits.  A high percentage of these decisions are made in error and can be reversed and the claim paid with an appeal.  An appeal has a fresh (and better trained) pair of eyes review the evidence in your case .  Often, the new decision is better. You Must Have Enough Quarters of Work.  You become an insured person under the Social Security Act by working and pay...
