WHY 70% OF ALABAMA DISABILITY CLAIMS GET DENIED

It's a fact that your odds of being denied Social Security disability is 7 out of 10.  We often scratch our heads, rub our chins and try to figure out why the number is so high.  Obviously, a majority of the people who file for disability shouldn't be denied, only to have their claims later approved on appeal.  As an experienced disability representative, here are some of the problems with initial disability determinations.  In combination, they deny far more people than they should.

  1. Social Security believes that many people will lie to them in order to get benefits.  Therefore, the system is designed to approve only the most obviously qualified persons.
  2. The people who make the decision about your claim have never met you.
  3. Social Security often makes a decision without a medical examination.
  4. If there is a medical examination, it is usually performed by a doctor who gets paid by Social Security. Think there might be a conflict of interest?
  5. If you are not represented, no one is there to make certain all of your medical evidence (such as your doctors' files) reach Social Security.
  6. "The cat" eats up all the questionable claims.  Social Security is the cat.
What becomes of the huge majority of cases that are denied?  One of two things:
  
Group 1:The cases that are not appealed promptly die and the claimant loses all of his or her benefits under the claim.  This is unnecessary but it happens. 

Group 2:  Other individuals will appeal their case to the next highest level and a majority of these people will eventually win their full benefits, including back pay denied by the erroneous decision.

Be sure you are included in Group 2. Immediately appeal unfavorable decisions.  Consider professional representation to help you.  Good representation isn't expensive.  It's priceless.  In fact, you pay nothing for representation until you win and collect your back pay.

POST HEARING EVIDENCE

Many people assume that a Social Security disability case is over when the hearing has been held.  This isn't always the case.  Often there is post hearing work that should be done to achieve the best chance of a favorable decision.
